Jurisdiction or Competent Courts
The parties, expressly waiving any jurisdiction that may correspond to them, for questions that may arise or actions to be exercised on the interpretation of compliance or non-compliance with what has been agreed herein, expressly submit to the Judges and Courts of the city of Vinaròs.
The customer agrees to receive invoices and credit notes for their returns in electronic format.
Most of shipments to European Union are made urgently 24-48 hours. The times shown are estimates, and start counting from the moment the order has left our warehouses.
The customer will have 48 hours from delivery to check the integrity of the order and all components it includes. After these 48 hours the shipment will be accepted and no claims will be accepted for damage caused in transit.
An order will be considered delivered when the delivery receipt is signed by the customer.
In case of receiving a product damaged by transport contact within the first 48 hours through firstname.lastname@example.org indicating the order number and the problem. Similarly, it is advisable to contact the transport company to record the incident.
Pinsbay offers the possibility of returning products if there is a manufacturer defect.
The return will not be applicable to products which have minor errors or minor scratches.
Returns of the following products will not be accepted, as established in Law 47/2002, of 19 December, amending Law 7/1996, of 15 January, on the Regulation of Retail Trade, for the transposition into Spanish law of Directive 97/7/EC, on distance contracts, and for the adaptation of the Law to various Community Directives.
Products subject to fluctuations in financial market coefficients that the seller cannot control.
Products manufactured according to customer specifications, customised or clearly personalised orders, specifically assembled according to a personalised configuration. Products that by their nature cannot be returned or can deteriorate or expire quickly.
All merchandise must be returned in full, in its original packaging, in perfect condition and protected so that it is not received with seals or adhesive transport tapes. Otherwise, Pinsbay reserves the right to refuse the return.
In no case the client will be able to use his own means to make the return.
If a customer makes use of the warranty and it does not proceed, either because the fault is not subject to warranty or because there is no damage or manufacturer error, the customer will bear the costs incurred, which in national shipments will be 35 €.
IMPORTANT: If a product has obvious defects or is in poor condition due to transport (knocks, water, etc.), Pinsbay must be notified in the 48H AFTER ACCEPTANCE OF THE ORDER. In this way we can claim it and replace it with another unit in perfect condition. Otherwise, Pinsbay reserves the right to accept the return.
The payments for returns will have a maximum term of 25 calendar days for administrative procedures, although we usually make them in no more than 7 days.
Assumptions in which we can not accept orders
Pinsbay reserves the right to cancel any purchase (of an order previously accepted by us), without being responsible for any damage or expense, among others, in the following situations:
– Your billing information is not correct or cannot be verified.
– Your order is flagged by our security systems as an abnormal or fraudulent order.
– We have reason to believe that you are under the age of 14.
– We have reason to believe that it has been done maliciously.
– The order is the result of an error in the shop system (misapplied discounts, unaccounted shipping costs, etc.).
– We were unable to deliver to the address provided.
Returns of material will only be accepted without unsealing and in perfect condition, during the 4 days.
Order cancellations will not be allowed after 1h. of the confirmation of production as it will be assumed that the order has already been processed by the factory. For any doubt send an email indicating the order number to email@example.com
The exercise of the right of withdrawal will imply the return of the price of the returned product and the original shipping costs. You will only have to assume the direct cost of returning the products.
